Terms of Use of API Yandex.Metrica Service

This document is a translation of Terms of Use of API Yandex.Metrica Service in English. In case of conflict between the Russian version of Terms of Use of API Yandex.Metrica Service and this translation - only the Russian version of Terms of Use of API Yandex.Metrica Service is legally binding. 1. General provisions

1.1. YANDEX limited liability company (hereinafter - Yandex) offers the Internet user (hereinafter -User) to use API Yandex.Metrica Service (hereinafter - Service), accessible at http://api.yandex.com/metrika, which enables the User’s different services and applications to interact with the Yandex.Metrica Service of Yandex on the following terms.

1.2. These Terms constitute an addendum to the User Agreement for Yandex Services regarding how to use the Service. Any issues concerning the use of the Service that do not fall under these Terms shall be regulated according to the Terms of Use of Yandex.Metrica Service (https://yandex.com/legal/metrica_termsofuse), the User Agreement for Yandex Services (https://yandex.com/legal/rules) as well as the License to use Yandex Search Engine (https://yandex.com/legal/termsofuse) and the Privacy policy (https://yandex.com/legal/confidential).

1.3. Starting using the Service, which includes having registered at the Service or having used any other feature provided by the Service, the User is deemed to have fully accepted these Terms as well as the terms of the above mentioned documents without any exception or reserve. In case the User disagrees with any of the provisions of the above mentioned documents, the User is not entitled to use the Service.

1.4. These Terms may be amended by Yandex without any preliminary notice. The new version of Terms comes into force from the moment it is posted on the Internet at the address below unless other is provided by the new version. The current version of Terms is always available at https://yandex.com/legal/metrica_api.

1.5. In case the User disagrees with any amendments of these Terms made by Yandex in accordance with paragraph 1.4. hereof, the User shall cease using the Service.

1.6. The Service provides the User with a free possibility to send inquiries to the Yandex.Metrica Service in order to create site traffic counters, control those and receive the site traffic statistics, as well as any other features for assessment of the site attendance with the Yandex.Metrica Service. The User is also entitled to use the Service in other ways that do not contradict these Terms as well as the provisions of the documents mentioned in paragraph 1.2. hereof. All current Service features as well as any development of those or introduction of new ones is the subject to these Terms.

2. Terms of the Service Use

2.1. Use of the Service is subject to the User complying with the following terms:

2.1.1. Use of the Service is available only to the Users having a Yandex account after the registration at the Service and receipt of the authorization key (the token);

2.1.2. While using the Service the User shall refer to the Yandex technology by placing the notice “The information is provided by the Yandex.Metrica system” and the hyperlink to http://www.metrica.yandex.com in “Yandex.Metrica” words in the “About the program” section or immediately next to the displayed data that is received with the Service. The font size of the notice shall not be smaller than the font size of the other inscriptions in the “About the program” section or the font size of the displayed data.

2.2. The technical conditions and the recommendations on the use of the Service are available at http://api.yandex.com/metrika/doc.

2.3. The Service (including the information received with it) is provided by Yandex “as is”. Yandex does not warrant the fitness of the Service for the purposes and expectations of Users, uninterruptable and error-free operation of the Service in whole and the counter installed on the User’s website in particular, and does not warrant the accuracy of the information obtained through the Service. Besides, Yandex does not warrant uninterruptable and error-free operation of the third-party software products or solutions (including libraries) recommended while using the Service (paragraph 2.2. of these Terms). Yandex shall not be liable for any damage, direct or indirect, caused to the User or any third party by use or inability to use the Service and/or counters installed on the User's website and/or the third-party software products and solutions (including libraries) recommended while using the Service, as well as by use or inability to use the information obtained through the Service. Yandex shall not reimburse the User or any third party for such damages.

2.4. The User bears full personal responsibility for the use and safety of his authorization key (the token) and cannot transfer or provide those to a third party. Yandex assumes no liability for the unauthorized use of the authorization key (the token) by the third party. All actions performed within the Service that were taken using the User’s authorization key (the token) are deemed to have been taken by the User.

2.5. The User shall be solely liable to any third party for their own actions while using the Service, including their compliance with the requirements of the legislation and non-violation of the third-party rights and interests. The User is obliged to settle all third-party claims arising from the actions of the User while using the Service independently and at his own expense.

2.6. Yandex reserves the right at its own discretion to limit the User’s access to the Service (or if technologically possible to certain features of the Service) with the User’s authorization key (the token), the account of the User or completely block the User’s account in case of repeated violations of these Terms, as well as apply other measures to the User in order to comply with the requirements of the legislation or with the rights and interests of third parties.
